Huawei Technologies Co., Ltd. ("HUAWEI") provides a voluntary manufacturer’s warranty for the HUAWEI product ("Product") you have purchased in accordance with these warranty terms ("Warranty").

Based on laws and regulations to protect the rights and interests of consumers in Germany, you can return the product, or have it replaced or repaired. For this you have the legal warranty rights against the seller of the product available to you.

This warranty is a voluntary manufacturer’s warranty, independent of and in addition to the buyer’s statutory rights under applicable consumer protection laws and any rights the buyer may have against the seller of the product. These statutory rights of the consumer in the event of defects may be asserted free of charge and shall not be impaired, limited, altered or superseded by the warranty. The warranty also stands independently alongside the consumer’s statutory warranty rights if the product is purchased directly from a HUAWEI subsidiary as the seller.

2.1 Warranty period

The warranty lasts from the date of purchase of the Product from the original retailer ("Warranty Period"): twenty-four (24) months for the Product.

2.2 Warranty Evidence

Generally, an electronic invoice, such as those sent by the seller via email or available on customer portals, is sufficient proof.

Only smartphones equipped with EMUI 9.0 or a newer system version were delivered, offer an e-warranty card.

The receipt must clearly indicate the model of the device with IMEI or SN and the date of purchase.

If necessary or relevant to clarify the facts, HUAWEI may request that the proof of purchase and/or other evidence or information relating to the date and place of purchase be provided. If this information is not provided, incomplete or intentionally illegible, HUAWEI reserves the right to refuse warranty service.

2.3 Warranty Policy

Within the Warranty

The claiming of the rights under this warranty is free of charge. Within the warranty period, you will not pay any expenses required for subsequent performance, be it material, transportation, labor, removal or travel costs or any other costs to repair or replace defective products covered by the warranty. In case of replacement, we will take back the replaced item free of charge.

In case of replacement or repair of a device, the original warranty continues unchanged. In any case, the limitation of claims under the warranty due to the claimed defect does not occur before the expiration of two months from the date when the repaired or replaced goods were handed over to you.

Outside the guarantee

Out-of-warranty repairs are not provided by Huawei. In this case, the respective repair center would be your contractual partner and any warranty conditions of the repair center would apply.

2.4 Scenarios not covered by the warranty

This warranty does not apply if any of the following circumstances apply:

  • The product is not purchased from a German or European channel;
  • The warranty period of the product has expired;
  • damage due to force majeure (such as. lightning, war, fire, typhoon, flood or earthquake);
  • Normal wear and tear of the device and accessories or other damage due to normal aging of the product. This includes, but is not limited to, scratches and damage to the plastic/glass surfaces and to any other external exposed parts resulting from normal use by the customer, unless the damage is due to a defect in material or workmanship;
  • Defects and damage resulting from improper use of the product, use outside the intended purpose described in the product’s operating instructions, improper handling, misuse, culpable conduct of the purchaser (intent or negligence) or accidents.
  • Performing disassembly, repair or modification not performed by HUAWEI or an authorized service center;
  • Defects or damage caused by improper testing, operation, maintenance, installation or any changes or modifications to the product;
  • Defects or damage caused by spilling food or liquids, corrosion, rust, or using the wrong voltage.

3. Commitment to repair quality

  • During the warranty period, HUAWEI or a HUAWEI authorized service center will, at HUAWEI’s sole discretion, repair or replace the product or related parts if the product is found to be defective in materials or workmanship.   • In case of repair, the defect will be repaired. If the defective product/part is replaced in whole or in part, HUAWEI shall provide another product/part. The repair or replacement of a product/part may also involve the use of functionally comparable refurbished products or parts that are as good as new in terms of performance and reliability.

4. Procedure for claiming warranty

  • The performance of warranty service may require the deletion of data stored on the device. Therefore, before you have the device repaired under this warranty, HUAWEI strongly advises you to back up any data (such as photos, contacts, call logs, etc.) that may exist on the device.). In addition, all security passwords must be deactivated and SIM cards and removable storage devices (z.B. memory cards) are removed.
  • Accessories such as z.B. Protective covers and screen protectors must be removed before warranty service is provided. HUAWEI shall not be liable for any damage or loss of accessories during repair or replacement.

5. Limitation of Liability of HUAWEI

  • Subject to the express warranties set forth above, HUAWEI makes no other warranties, express or implied, with respect to its products.
  • HUAWEI shall be liable for whatever legal reason within the scope of fault-based liability only for intent and gross negligence. In case of ordinary negligence HUAWEI shall be liable, subject to statutory limitations of liability (in particular due diligence in own matters and minor breaches of duty) for damages resulting from injury to life, body or health and for damages resulting from breach of a fundamental contractual obligation. An essential contractual obligation is an obligation, the fulfillment of which enables the proper performance of this warranty in the first place and on the observance of which the contractual partner regularly relies and may rely on. In case of breach of an essential contractual obligation, HUAWEI’s liability is, however, limited to the compensation of the foreseeable, typically occurring damage.
  • The limitations of liability resulting from the above also apply to possible breaches of duty by representatives or vicarious agents of HUAWEI. They do not apply if a defect has been fraudulently concealed or if HUAWEI has assumed an independent guarantee for a quality of the goods as well as in case of claims of the purchaser according to the Product Liability Act.
  • The HUAWEI customer service will inform you about the appropriate procedure for the assertion of warranty claims and will also provide shipping labels. HUAWEI assumes no responsibility for loss or damage to products sent in on its own initiative through channels other than those provided by HUAWEI.

1. General

Huawei Technologies Co., Ltd. ("HUAWEI") provides a voluntary manufacturer’s warranty for the HUAWEI product ("Product") purchased by you in accordance with these warranty terms and conditions ("Warranty").

Based on laws and regulations protecting the rights and interests of consumers in Germany, you can return the product or have it replaced or repaired. You may exercise your statutory warranty rights against the seller of the product.

This warranty is a voluntary manufacturer’s warranty, independent of and in addition to the purchaser’s statutory rights under applicable consumer protection laws and any rights the purchaser may have against the seller of the product. These legal rights of the consumer in case of defects can be asserted free of charge and are neither affected limited, changed nor replaced by the warranty. The warranty is independent of the consumer’s statutory warranty rights even if the product is purchased directly from a HUAWEI subsidiary as seller.

It is the sole and free decision of the consumer whether to make claims under this warranty or under the statutory warranty rights.

1.1 Applicable products

This warranty is valid only for Desktops& Monitors and Included Huawei branded accessories purchased in Germany. If the product was purchased in a Member State of the European Union, Iceland, Norway, the United Kingdom or Switzerland, the warranty of the country of purchase applies.

If the product is purchased in one of the countries listed above, this warranty is valid in each of these countries. Warranty service may be delayed if it is provided in a country other than the country of purchase
