Mandatory information in the imprint – address, name and what else?

The imprint – Almost every website has it and everyone who creates a new website must of course ask himself: Do I need an imprint?? What mandatory information must be provided in the imprint? Do I have to enter my address? Can I be liable to prosecution if I do not give correct information? Mailboxnow clarifies.

What is the imprint?

But what exactly is the imprint at all? The term does not originate from the online world, but from press law. For many years, however, the term has been used to provide the most important information about the owner on websites.

The imprint is usually a separate subpage of a domain, in which legally required information of the owner is made. The imprint must be visible and easy to find for visitors. Most websites handle this by placing the link to the imprint in the footer of the page, i.e. at the very end. This should be the case on each subpage.

Which mandatory information must be included in the imprint?

The content of the imprint is regulated in the Telemediengesetz (TMG §5) and in the Rundfunkstaatsvertrag (§55 RStV). According to TMG §5 businesslike online services have to indicate their summonable address in the imprint. This means that all websites that are of a business nature and offer services or goods for a fee must present a valid address in the imprint. Also the name of the website owner must not be missing here.

It can vary from company and industry, which information exactly must be made in the imprint. The following information should be included in any case:

  • Name
  • Street, house number
  • ZIP CODE
  • city
  • E-mail address
  • Telephone number or cell phone number
  • Fax number (optional)
  • legal form
  • register entry
  • UstID

Of course, all information must be current and truthful.

Do private individuals also have to include an imprint?

Private persons may also be obliged to include an imprint on their website with all necessary mandatory information. Here we refer to §55 RStV, which states that the imprint obligation refers to the website content. Speak: On the information of the website. Does your website contain journalistic content and news that contribute to the formation of opinion? Then you might be obliged to keep an imprint with all mandatory details.

As you probably already recognize, the law is not completely clear, which concerns the imprint obligation. Finally, it is a subjective assessment as to when a content is considered opinionated or journalistic. Therefore, in case of doubt, even hobby bloggers are recommended to create an imprint. Alone Blogger, which write only purely over private things, are to be excluded from the imprint obligation.

The mandatory information for private individuals is somewhat shorter. Here the name, the address and an e-mail address are sufficient.

Imprint warnings

If no imprint is integrated on the web page, although all conditions for it are fulfilled, there can be quite warning letters. However, courts in the past have made mixed decisions on whether failure to comply with the imprint is a violation of the law. Therefore, it is recommended to always include an imprint and to have the mandatory information checked by a lawyer.

Imprint can be created by means of a generator

In the meantime, there are numerous free tools on the net with which an imprint can be created. However, they are not liable for the correctness of the information provided. Therefore, you should always have the result of a generator checked by a lawyer for its legitimacy. There are different rules for different websites. For example, lawyers and architects must include additional, profession-specific mandatory information in their imprint.
